NYC's Earned Safe and Sick Time Act (ESSTA) and New York State's Paid Prenatal Leave law both affect hourly employers operating in NYC. They don't directly govern commuter benefits, but they share the same workforce, hourly and frontline, where Alice operates. Here's a brief on each, and where they intersect.

ESSTA overview

ESSTA requires NYC employers to provide paid safe and sick leave. Accrual is generally one hour per 30 hours worked, capped at 40 or 56 hours per year depending on employer size. The law covers both full-time and part-time employees. Penalties for non-compliance can reach $500 per employee for certain violations.

Paid Prenatal Leave (New York State)

Effective January 1, 2025, New York requires employers to provide 20 hours of paid prenatal leave per 52-week period for pregnant employees, separate from any other accrued leave. This is a state law applying to most private employers.

How they intersect with commuter benefits

Hourly workers using paid leave (sick, prenatal, vacation) still have commuter elections in place. While they're not commuting on a leave day, their pretax election continues (or pauses, depending on plan design). Pay-period flexibility in Alice means employees can adjust elections during extended leave so they don't accumulate unused balances.

What employers need to do

ESSTA and Paid Prenatal Leave are separate compliance areas with their own posting, recordkeeping, and payroll requirements. Alice doesn't administer either, but multi-state and NYC-based employers using Alice often manage both alongside commuter compliance.
