Final paycheck rules for commuter balances when an employee leaves

When an employee leaves, unspent §132(f) commuter pretax balances are not paid out in the final paycheck. The IRS prohibits cash-out of unused commuter benefit dollars. State wage-payment laws generally do not override this federal rule because the dollars in question were never wages once they were pretax-elected.

The federal floor

IRC §132(f) makes the commuter exclusion contingent on the dollars being used for qualifying commute expenses. Cashing them out converts them to taxable wages, which defeats the exclusion. Plans don't have a permissible mechanism to refund unspent commuter pretax balances to a departing employee.

State wage payment laws

States like California (final paycheck due immediately), New York (within seven days), and others have strict final-pay rules. Those rules apply to wages owed. Pretax commuter dollars are not "wages owed"; they're an exclusion the employee elected. The final paycheck calculation includes wages earned through the last day, minus the last pretax deduction (which may or may not be coded depending on plan and termination timing).

What's actually in the final paycheck

Gross wages earned through the termination date, minus taxes, minus any final pretax deductions that the employer's payroll system processed for that period. If a final commuter deduction was scheduled for that pay period, it would still come out unless adjusted.

Run-out window

Most plans give a 30 to 90 day window after termination to use remaining commuter dollars for qualifying expenses already incurred. After that, unused dollars are forfeited (not paid out). Specific run-out periods depend on your employer's plan design.

Practical guidance

Right-size your last election. Use up your balance on qualifying commute expenses before your last day. Don't expect a check for unused balance.
